  1. PowerPlugs(tm): Transitions(tm) End User License Agreement

  3. Please carefully read this License Agreement before using the PowerPlugs: 
  4. Transitions product.  Using this product indicates your acceptance of this 
  5. Agreement's terms. If you do not agree with any of the terms, do not use
  6. this product.

  10. Terms and Copyright Notice.   The terms of this License Agreement supersede any 
  11. other license agreements accompanying the PowerPlugs: Transitions product. You 
  12. are granted a license to use the PowerPlugs: Transitions product, which 
  13. includes, but is not limited to software program files, data files (including, 
  14. but not limited to any images, photographs, animations, transition effects, 
  15. video, sound effects, music), and documentation (the "PRODUCT") for personal use 
  16. or in your business or profession.  Copyright (c) 1999 CrystalGraphics,
  17. Inc. All rights reserved.  All title and copyrights in and to this PRODUCT and 
  18. all accompanying help files and other documentation (the "DOCUMENTATION") are
  19. owned by CrystalGraphics  Inc.  The PRODUCT and DOCUMENTATION are protected by
  20. copyright laws and international copyright treaties, as well as other
  21. intellectual property laws and treaties.  Therefore, you must treat the
  22. PRODUCT and DOCUMENTATION like any other copyrighted material.

  24. Installation and Use.  You may install and use one copy of the PRODUCT and 
  25. DOCUMENTATION. You may not  make copies, reproductions, translations or 
  26. modifications of or to the PRODUCT or DOCUMENTATION, except you may make a 
  27. single archive copy of the PRODUCT.  The same copyright notice and proprietary 
  28. marking as appears on the original PRODUCT must be contained on the archive 
  29. copy.

  31. Reproduction and Distribution.   Neither the PRODUCT nor the DOCUMENTATION may 
  32. be copied or distributed to anyone without written authorization from 
  33. CrystalGraphics, Inc.

  35. Description of Limitations.  You may not disassemble, create derivative works, 
  36. modify, reverse engineer, adapt, decompile, or translate the PRODUCT or the 
  37. DOCUMENTATION. You may not adapt, create derivative works, or translate any part 
  38. of the documentation without the prior written consent of CrystalGraphics, Inc.
  39.  
  40. Transfer.  You may permanently transfer all of your rights under this License 
  41. Agreement provided the recipient  agrees to the terms of this License Agreement.

  43. LIMITED WARRANTY
  44.  
  45. CRYSTALGRAPHICS, INC. IS NOT RESPONSIBLE FOR THE INSTALLATION, USE OF OR RESULTS 
  46. OBTAINED FROM THE PRODUCT OR DOCUMENTATION.  CRYSTALGRAPHICS DOES NOT WARRANT  
  47. YOUR REQUIREMENTS WILL BE  MET WITH THE PRODUCT'S FUNCTIONS OR THAT THE 
  48. DOCUMENTATION OR  PRODUCT'S  OPERATION WILL  BE ERROR-FREE OR UNINTERRUPTED, OR 
  49. THAT DEFECTS WILL BE CORRECTED.

  51. CRYSTALGRAPHICS HAS USED REASONABLE EFFORTS TO MINIMIZE ERRORS OR DEFECTS IN THE 
  52. PRODUCT AND DOCUMENTATION.  YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS 
  53. FROM USE, OR INABILITY TO USE THE PRODUCT AND DOCUMENTATION.  THE PRODUCT AND 
  54. DOCUMENTATION IS PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND, EXPRESSED OR 
  55. IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY 
  56. AND FITNESS FOR A PARTICULAR PURPOSE.

  58. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES SO THE ABOVE 
  59. EXCLUSION MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS 
  60. AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

  62. IN NO EVENT WILL CRYSTALGRAPHICS OR ITS AUTHORIZED REPRESENTATIVES BE LIABLE TO 
  63. YOU FOR ANY DAMAGES, INCLUDING LOSS OF PROFITS, LOST SAVINGS, OR OTHER 
  64. INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR THE USE OF OR INABILITY
  65. TO USE SUCH CRYSTALGRAPHICS PRODUCT AND DOCUMENTATION EVEN IF CRYSTALGRAPHICS,
  66. INC. OR ITS AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF
  67. SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.

  69. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL 
  70. OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATIONS OR EXCLUSION MAY NOT APPLY TO 
  71. YOU.

  73. EXCLUSIVE LIMITATION AND REMEDIES LIABILITIES

  75. CRYSTALGRAPHICS ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY AGAINST 
  76. CRYSTALGRAPHICS, INC. OR ITS AUTHORIZED REPRESENTATIVES FOR LOSS OR DAMAGE 
  77. CAUSED BY ANY FAILURE OR DEFECT OF THE PRODUCT OR DOCUMENTATION, REGARDLESS OF 
  78. THE FORM OF ACTION, WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT
  79. LIABILITY OR OTHERWISE, SHALL BE THE REPLACEMENT OF THE PRODUCT.  CONTACT YOUR
  80. ORIGINAL SOURCE OF PURCHASE TO RECEIVE INSTRUCTIONS ON OBTAINING REPLACEMENT
  81. PRODUCT.  THIS WILL BE EXCLUSIVE OF ALL OTHER REMEDIES AGAINST CRYSTALGRAPHICS,
  82. INC. AND ITS AUTHORIZED REPRESENTATIVE, EXCEPT FOR YOUR RIGHT TO CLAIM DAMAGES
  83. FOR BODILY INJURY TO ANY PERSON.
